Work related road driving is one of most dangerous activities undertaken by the rail workforce. During the last 10 years there have been 18 workforce fatalities and of these 9 were work-related road deaths. 50% of all workforce fatalities.

The requirements of the Health and Safety at Work, etc Act 1974 apply to employees driving for work. The Management of Health and Safety at Work Regulations 1999 requires Employers to risk assess their driving for work activities and manage those risks effectively within a safety management system.

In addition, the Corporate Manslaughter and Homicide Act 2007 applies to driving for work, and consequently charges of corporate manslaughter are possible in the event of work-related road deaths. So, too, are charges of gross negligence manslaughter against individuals.

The Rail Industry Road Risk Resource Centre has been developed by RSSB in partnership with Highways England’s Driving for Better Business (DfBB) team, to offer rail organisations a comprehensive resource to support the effective management of occupational road risk across the rail industry and supply chain.

There are three sections:

  • The introduction of DfBB programme to help each organisation improve the management of occupational road risk across their business
  • How to get involved with the wider rail industry and collaborate with others to learn and share good practice to improvement the management of road risk
  • Access to work related road risk safety performance data & analysis

This resource centre aims to support

  1. Leaders and Senior Managers
  • Those with the responsibility for work-related road risk policy + management arrangements
  1. Company Road Risk Champions (Road Vehicle Fleet Managers/H&S Managers)
  • The focal point and the organisation’s representative for DfBB and LHSBR road risk collaboration
  1. Managers of employees and employees who are driving road vehicles for work purposes or commuting to work, and workforce passengers in road vehicles.

To help managers who are required to undertake risk assessment and to put in place control measures to protect the health & safety of their employees.

Driving for Better Business programme (DfBB)

RSSB and Highways England are collaborating together to encourage rail companies to register and engage with the ‘Driving for Better Business’ programme. This programme is aimed at helping all UK companies to risk assess work related road risk across their businesses and to implement effective policies and management arrangements.   

The ‘Driving for Better Business’ programme is based around the 7 steps to excellence.

Each step is supported by a range of information to help you manage work related road safety effectively. 

Road Risk Collaboration

The driving force behind the rail industry road risk collaboration programme is The Leading Health & Safety on Britain’s Railway (LHSBR) strategy.

LHSBR Section 5.4 – road driving risk, sets the key challenges for industry to collaborate on together: 

  • Improve knowledge of driving patterns, hours, distances, and accidents to raise awareness and develop industry-wide priorities for improving road driving safety
  • Learning from other industries through benchmarking approaches to improving road driving risk.
  • Agreed good practice protocols and codes of practice in all key areas relating to road driving
  • Sharing good practice between train operators to align policies on rail replacement bus services and company taxis
  • More comprehensive reporting of RTCs into SMIS and close-call relating to road driving across all rail companies and suppliers to build intelligence and inform decisions at industry level for further improvement

One of the key challenges set out in the LHSBR road risk section is for the rail industry to improve the reporting of RTCs into SMIS and close-call relating to work-related road driving across all rail companies and suppliers; and to build intelligence and inform decisions at industry level for further improvement.

This section provides information on when a road traffic collision involving an employee travelling for work purposes should be reported into SMIS, and a library of published quarterly road risk safety performance reports containing data & analysis, learning from operational experiences and rail industry sector updates on collaboration road risk reduction/improvement programmes.

The Occupational Road Risk Management Charter - a Leadership Statement of Intent

This Charter sets out a series of commitments to reduce road risk - the likelihood of being killed or injured while driving, or being driven, for work purposes, by the effective management of occupational road risk. The charter commitments also extend to your supply chain.
